Mediation Without Attorneys

Resync has a strong commitment to providing mediation services for individuals who are not represented by an attorney.

All mediation without attorneys begins with an individual initial session in which we review how mediation works, issues, communication style and preferences, the various methods of obtaining and providing information when working with Resync, the likely time and cost, decision making skills, as well as some communication techniques and tips that allows parties to be able to comfortably and effectively use the mediation process.

Once you decide to mediate with Resync we will provide you with access to your personal account and review with you how to use your message center, scheduling, document files, video conferencing and additional features.

Pricing: $125/hour standard fee

  • Sliding fee based on annual income:
  • $50/hr with income ≥ $25,000
  • $100/hr $25,000-$60,000
  • $125/hr for income ≤ $60,000

Mediation With Attorneys

Resync provides facilitative or evaluative mediation that includes both parties and their attorneys at any stage of a family law case.

Attorneys may want to diffuse the stress of a high conflict case by referring some clients to the individual model of Resync. This will give the client the opportunity to identify their interests and practice decision making skills.

Pricing: $250/hour standard fee.

Pre-Mediation Session

Resync Mediation offers a pre-mediation session to explore and practice conflict resolution and communication skills that will that will be helpful throughout mediation, the court process, or in any high conflict situation. Pre-mediation sessions are a ninety minute to two-hour one on one session that provides information on the mediation process as well as an opportunity to learn and practice conflict resolution skills.

This service is helpful for people who want to find out more about the mediation process before their first mediation session and for people who want to build skills for staying centered within high conflict situations.

Pricing: $95/session standard fee.
Sessions last between 90 minutes – 2 hours.

FAQs

Do I need an attorney during mediation?

At Resync Mediation parties usually mediate without an attorney. However, we suggest parties have any mediated agreement reviewed by an attorney before formalizing the agreement in a legal document.

Because many situations involve significant legal or financial issues it can be helpful to work with an attorney during the mediation process. Many attorneys will provide representation for specific tasks, such as answering legal questions, reviewing your agreement, or preparing court documents after an agreement is reached.

There are some situations in which both parties are represented by an attorney and in which it is helpful for both parties and both attorneys to participate in mediation on some or all issues before a contested court hearing.

Is mediation confidential?

Yes. Mediation is a confidential process. Information provided during the mediation process including discussions, messages, forms, summaries, & any unsigned mediated agreements are not subject to discovery or other disclosure and are not admissible in any court or contested proceeding.

Is mediation right for everyone?

Mediation may not be a good choice to resolve issues if there are concerns about mental illness, chemical dependency, or cognitive limitations that impact the ability of a party to understand or participate in the process.

If there is a history of physical or emotional abuse in the relationship or if one of the participants feels intimidated or is simply uncomfortable disagreeing with the other party mediation may not be the best process.

However, at Resync Mediation, each person’s unique circumstances and unique communication style are taken into consideration to design a process that provides the information, tools, and flexibility needed to allow most everyone to participate in mediation.

Is mediation appropriate for situations with power imbalances/ domestic abuse?

At Resync Medication screening for power imbalances begins at the Intake Process and continues throughout mediation.

Safeguards are built into the mediation process to provide a safe, supportive environment that allows parties to be effective advocates for themselves and their children.

In many cases it is important for parties to take back their power in a supportive environment rather than to continue to give away their power by allowing someone else to make decisions.

Is my confidental information secure within Resync's online platform?

Resync’s online platform provides solid security for your information, sessions, and communications. The platform provides you with enhanced security that is not available in your general email account, online communications, and document storage. Your personal information is encrypted and stored privately by Resync Mediation.
